These Terms of Use (the “Terms”) govern your access to and use of our websites, online stores, content, and services that link to these Terms (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2) Eligibility & Accounts

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Site. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3) Acceptable Use & User Conduct

You agree not to:

- Violate any applicable law, regulation, or third‑party right.
- Scrape, crawl, spider, or use automated means to access or copy the Site or its content without our prior written permission.
- Interfere with the Site’s security features or attempt to gain unauthorized access to any systems or data.
- Upload or transmit viruses, malware, or other harmful code.
- Harass, threaten, or abuse others; post defamatory, obscene, or infringing content.
- Misrepresent your identity, affiliation, or the origin of content.
- Reverse engineer, decompile, or modify the Site except to the extent permitted by law.

All content on the Site—including photos, videos, copy, logos, graphics, designs, guides, itineraries, product names, and trademarks—is owned by or licensed to Shades of Nature and protected by U.S. and international copyright, trademark, and other laws. Melanin in the Mountains™ and other marks are trademarks of Shades of Nature.

You may view the Site for your personal, non‑commercial use only. No rights are granted to copy, reproduce, distribute, publicly display, create derivative works from, or otherwise exploit any content without our express written permission.

User Content. If you submit or post content (e.g., product reviews, trip photos, comments) you grant us a non‑exclusive, worldwide, royalty‑free, sublicensable license to host, store, use, reproduce, modify, adapt, publish, translate, create derivative works from, and display such content in connection with operating, marketing, and improving the Site and our products/services. You represent that you own or control all rights in your submissions and that your content does not infringe any third‑party rights.

DMCA/Reporting Infringement. If you believe your copyrighted work has been copied on the Site in a way that constitutes infringement, please send a notice to: [DMCA Agent Name], [Address], [Email], with the information required by 17 U.S.C. §512(c)(3).

5) Purchases, Payments & Order Policies

When you place an order, you are making an offer to buy the products listed. We may accept or reject any order for any reason, including limited availability, suspected fraud, or pricing/typographical errors.

Pricing & Errors. We strive for accuracy but errors may occur. If we discover an error in price or availability, we may cancel or refuse the order (even if you received an order confirmation) and will either contact you for instructions or cancel and issue a refund.

Taxes. Prices shown may not include applicable sales, use, VAT/GST, or other taxes. You are responsible for all such taxes, duties, and fees as required by law.

Shipping/Returns. Shipping estimates are provided at checkout. Returns, exchanges, and refunds are governed by our Shipping & Return Policies. By placing an order you agree to those policies.

Resale Prohibited. Products purchased are for personal use only and may not be resold without our prior written consent.

6) Trips, Events & Experiences

We occasionally offer group trips, experiences, or events (collectively, “Trips”). Trips are governed by our separate Trip Terms & Conditions, which address cancellations, transfers, minimum headcount, itineraries, supplier terms, travel insurance, and force majeure. By booking a Trip you agree to the Trip Terms. If a conflict exists between these Terms and the Trip Terms, the Trip Terms control for Trip matters.

Risk Notice. Outdoor activities (e.g., hiking, water activities, zip‑lining) involve inherent risks. You are solely responsible for judging your fitness and preparedness, following instructions, and complying with local regulations and park rules. Participation is voluntary and at your own risk.

7) Health, Fitness & Safety Disclaimers

Information on the Site—including trail guides, packing lists, fitness tips, and itineraries—is provided for general informational purposes. It is not professional health, safety, legal, or travel advice. Conditions can change rapidly (weather, closures, trail conditions). Verify current conditions with official sources and use your own judgment.

8) Third‑Party Links, Tools & Affiliates

The Site may contain links to third‑party websites, merchants, booking platforms, or tools (e.g., mapping widgets). We do not control and are not responsible for third‑party sites or services. Your use of third‑party services is at your own risk and subject to their terms and policies.

We may participate in affiliate programs and may earn commissions from qualifying purchases or bookings made via certain links. We strive to recommend only products and experiences we genuinely believe in.

9) Warranty Disclaimer

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE, CONTENT, AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. 10) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SHADES OF NATURE, ITS OWNERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, PRODUCTS, OR TRIPS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SITE, PRODUCTS, OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) OR SERVICE(S) AT ISSUE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages; the above may not apply to you to the extent prohibited by law.

11) Indemnification

You agree to defend, indemnify, and hold harmless Shades of Nature and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Site; (b) your violation of these Terms; or (c) your infringement of any intellectual property or other right of any person or entity.

12) Governing Law & Venue

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of laws principles. You agree that the state and federal courts located in Fulton County, Georgia will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site, and you consent to personal jurisdiction and venue in those courts.

13) Changes to the Site & Terms

We may modify the Site or these Terms at any time. If we make material changes, we will update the Effective Date at the top of this page and, where appropriate, provide additional notice (e.g., posting a banner or sending an email). Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

14) Privacy

Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use, and share personal information.

15) Miscellaneous

Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any right or provision will not be deemed a waiver of such right or provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets.
Entire Agreement. These Terms, together with the policies linked above, constitute the entire agreement between you and Shades of Nature regarding the Site.
